IMPORTANT-READ CAREFULLY: This End-User License Agreement ("EULA") is a legal agreement between you as an individual and Zian Choy, which provided the software product(s) identified above ("SOFTWARE PRODUCT" or "SOFTWARE"). The SOFTWARE PRODUCT includes computer software, and may include associated media, printed materials, and "online" or electronic documentation. By installing, copying, downloading, accessing, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, Zian Choy ("ZC") is unwilling to license the SOFTWARE PRODUCT to you. In such an event, you may not use or copy the SOFTWARE PRODUCT, and you should promptly destroy any traces of it in your possession.
SOFTWARE PRODUCT LICENSE
Copyright laws and international copyright treaties, as well as other intellectual property laws and treaties protect the SOFTWARE PRODUCT. The SOFTWARE PRODUCT is licensed, not sold. The term "COMPUTER", as used herein shall mean the HARDWARE, if the HARDWARE is a single computer system, or shall mean the computer system with which the HARDWARE operates, if the HARDWARE is a computer system component.
1. GRANT OF LICENSE. This EULA grants you the following rights:
(a) Software Installation and Use
You may only install and use one(1) copy of the SOFTWARE PRODUCT on one(1) COMPUTER.
(b) Storage/Network Use
The SOFTWARE PRODUCT may not be installed, accessed, displayed, run, shared, or used concurrently on or from different computers, including a workstation, terminal, or other digital electronic device owned or operated by you.
(c) Back-up Copy
You may use the back-up copy solely for archival purposes. You may make a single back-up copy. Except as expressly provided in this EULA, you may not otherwise make copies of the SOFTWARE PRODUCT, including any the printed materials accompanying the SOFTWARE.
(d) Other Permitted Reasons for Copying
You may make copies of the entire SOFTWARE PRODUCT solely for the purpose of distribution to others. The copies made must explicitly state that the SOFTWARE PRODUCT was created by ZC. They must also state that the SOFTWARE PRODUCT is copyrighted by ZC in addition to having this EULA attached to them. You may not charge any fee for the copies you distribute.
2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
Limitations on Reverse Engineering
You may not modify, decompile, or otherwise reverse engineer the SOFTWARE PRODUCT, except for activity that is expressly permitted by applicable law notwithstanding this limitation.
3. COPYRIGHT.
(a) General Copyrights
All title and intellectual property rights in and to the SOFTWARE PRODUCT (including but not limited to any text incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT, are owned by ZC unless otherwise stated. All title and intellectual property rights in and to the content which may be accessed through use of the SOFTWARE PRODUCT is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This EULA grants you no rights to use such content. ZC reserves all rights not expressly granted under this EULA.
4. EXPORT RESTRICTIONS.
You agree that you will not export or re-export the SOFTWARE PRODUCT to any country, person, or entity subject to U.S. export restrictions. You specifically agree not to export or re-export the SOFTWARE PRODUCT: (i) to any country to which the U.S. has embargoed or restricted the export of goods or services; (ii) to any person or entity who you know or have reason to know will utilize the SOFTWARE PRODUCT or portion thereof in the design, development or production of nuclear, chemical or biological weapons; or (iii) to any person or entity who has been prohibited from participating in U.S. export transactions by any federal agency of the U.S. government.
5. CONSUMER RIGHTS.
Consumers may have the benefit of certain rights or remedies pursuant to the Trade Practices Act and similar state and territory laws in Australia or the Consumer Guarantees Act in New Zealand, in respect of which certain liability may not be excluded.
